The seatpost bolt is going to hold it together. Probably would be a good idea to use a nice long MTB type seatpost that will extend well down below the damaged area.
The seller is being properly cautious to say not to ride it, but I wouldn't take that too seriously. If you use a nice long post, the worst case failure would be that the seatpost would slip down into the frame.
