When I worked at American Classic in the mid-90's I had the chance to read some court transcripts pertaining to that suit. Bill Shook, the founder of A.C., had constructed bonded, oversize-tubed aluminum frames for himself to race on in the early to mid 70's, and this was one of the cases used to decide the ultimate outcome of that suit. Both Klein and Cannondale had pioneered the marketing of OS aluminum tubes in bike frames, but there were several independently designed and manufactured examples, even previous to their efforts, that proved they did not pioneer the technology itself.
