All things considered, it sounds like fraud to me. Certainly the misrepresentation of sizing alone substantiates that claim.
   Beyond that, it's hard to imagine the seller didn't know about the kickstand damage. I don't know what ebay does in the case of fraudulent auctions but in this case I think you should try and use whatever services are available.
