I had a similar problem ; got a TA Tevano crankset from UK with a MAJOR pea-sized crack in the spider, and after a few rounds of sending pictures the seller refunded the entire price including shipping. I feel kind of bad about this because there is some residual value in the left crank arm and chainring. I really should sell off the remaining parts and return those $$$ to the seller.

I'd think that the seller of the ALAN should give you a refund for the frame portion of the sale, and a goodly credit towards the shipping charges. I presume that the rest of the bike parts are o.k.

There are places you could take the frame in the USA to get it fixed; I think that Mel Pinto imports can give you suggestions, also ask another current importer - http://www.euromediagroup.us/alan_road.php.

The rest of the parts could either be liquidated on ebay to recoup your losses, or you could swallow the repair charges (which will probably be higher than the credit for the frame portion of the transaction), and get it fixed. I'd probably opt for the latter as long as the repair wasn't too exhorbitant.
