For me, the great irony of this situation is that Campagnolo is punctilious in its persecution/prosecution of anyone who would deign to manufacturer reproduction replacement parts, even when Campagnolo no longer produces those pieces.

\r?\n> First, let me apologize in advance if I am coverning ground

\r?\n> already

\r?\n> tread upon. I am only half following this discussion.

\r?\n> Having said

\r?\n> that...

\r?\n>

\r?\n> So I talked to an Art Buyer friend of mine and she found

\r?\n> this to be a

\r?\n> pretty interesting situation. As far as copyright is

\r?\n> concerned, any

\r?\n> images Campy "borrowed" that were simply scans or

\r?\n> photos of Campagnolo

\r?\n> printed material is technically owned by Campy. They could

\r?\n> basically

\r?\n> argue the reverse. It was scanned/used without their

\r?\n> permission and

\r?\n> that they technically own the image. Using said image would

\r?\n> not be a

\r?\n> good case for copyright infringement, but it's just

\r?\n> downright bad

\r?\n> form.

\r?\n>

\r?\n> BUT, as for original photography, featuring campy

\r?\n> components/equipped

\r?\n> bicycles, that weren't for commercial use, the original

\r?\n> photographers

\r?\n> own the rights to these. A case could be made that

\r?\n> Campagnolo violated

\r?\n> copyright law and must either a, cease and desist or b,

\r?\n> compensate the

\r?\n> original photographer.

\r?\n>

\r?\n> Where it get complicated though is how this is treated with

\r?\n> international copyright law. Italy is a member state that

\r?\n> has several

\r?\n> treaties as recent as the WTO treaty of '95 to honor

\r?\n> copyrights

\r?\n> between countries.

\r?\n>

\r?\n> Now whether someone wants to test the waters and put effort

\r?\n> into this

\r?\n> is another story. I would be curious to know what

\r?\n> Campangolo's

\r?\n> response would be if someone where to send them a C&D

\r?\n> letter.
