I would not want the brake touching my frame anywhere but at the bolted pressure points. This holds true under hard braking conditions as well. My opinion is that there needs to be washers or the spacer between the brake and the frame in your case. Maybe get some fender washers, since they have a larger OD and give you the widest support base for the brake.
